For most Americans, the automobile represents something deeply personal — a private space, a refuge between destinations, a place for phone calls, arguments, and unguarded moments. That perception deserves a serious correction. The vehicle sitting in your driveway today is, in all likelihood, one of the most sophisticated surveillance instruments you own. It records where you go, how you drive, what you say, and increasingly, how you look — transmitting that information to parties you may never have knowingly agreed to share it with.
This is not a hypothetical threat. It is the documented operational reality of the modern automotive industry.
The Data Your Vehicle Collects — And the Breadth May Surprise You
Contemporary connected vehicles generate data across several distinct categories, each carrying its own privacy implications.
Location and Movement Data is perhaps the most intuitive. Virtually every vehicle sold in the United States over the past decade contains GPS hardware that logs trip history with timestamp precision. This data can reconstruct a detailed map of your daily life — your medical appointments, your place of worship, your political gatherings, your personal relationships — in ways that a simple phone record cannot.
Driver-Monitoring Systems (DMS) represent a newer and considerably more invasive layer. Sold to consumers as safety features designed to detect drowsiness or distraction, cabin-facing infrared cameras in vehicles from manufacturers including General Motors, Ford, Subaru, and several luxury brands now continuously analyze the driver's face. These systems can infer emotional state, attention level, and in some implementations, biometric identifiers. The footage and derived data do not always remain on the vehicle.
Microphone and Voice Activation Logs add an audio dimension. Built-in voice assistants — whether native to the automaker's platform or integrated through Apple CarPlay and Android Auto — may retain recordings of in-cabin conversations. Several manufacturers have faced scrutiny over ambiguous retention policies that leave open the question of what is stored, for how long, and under what circumstances it is reviewed.
Behavioral and Telematics Data rounds out the picture. Acceleration patterns, braking force, cornering behavior, seatbelt usage, and even the specific roads you travel are routinely captured by onboard diagnostic systems. This category of data has become particularly valuable to the insurance industry.
Who Receives Your Vehicle's Data — And Under What Authority
The answer to this question is more complicated than most drivers would prefer.
Automakers operate under privacy policies that are frequently lengthy, written in technical language, and revised without prominent notice. A 2023 investigation by the Mozilla Foundation reviewed the privacy practices of 25 major automakers and concluded that the automotive industry represented "the worst category of products for privacy" the organization had ever examined. The report found that the majority of manufacturers claimed the right to share or sell personal data to third parties, including data brokers, law enforcement agencies, and commercial partners.
Insurance companies have become among the most aggressive consumers of vehicle telematics. Programs marketed as optional usage-based insurance discounts — offered by carriers including LexisNexis Risk Solutions' data partners — have, in documented cases, enrolled drivers without explicit informed consent, then used that behavioral data to raise premiums rather than lower them. A New York Times investigation published in 2024 revealed that General Motors had shared driving data from millions of customers with insurers through its OnStar Smart Driver program, in many cases without drivers understanding they had enrolled.
Government and law enforcement access presents a separate dimension. Law enforcement agencies have increasingly sought vehicle location records, event data recorder (EDR) logs, and infotainment system backups through subpoenas and court orders. The legal framework governing such access remains inconsistent across jurisdictions, and automakers' disclosure practices vary considerably.
Third-party application ecosystems further complicate data boundaries. When drivers connect smartphones to vehicle infotainment systems, data flows in both directions. The permissions granted within a third-party app may extend to information harvested during that connection — contact lists, message previews, and location data among them.
Which Automakers Warrant the Closest Scrutiny
Not all manufacturers approach data collection with equal aggressiveness, though the industry-wide trend moves consistently toward expansion rather than restraint.
General Motors has faced the most prominent recent criticism in the United States, specifically for its OnStar connectivity platform and its data-sharing arrangements with insurance data aggregators. The company subsequently announced changes to its Smart Driver program following congressional and regulatory attention, though privacy advocates have characterized those changes as insufficient.
Tesla's data collection architecture is notably comprehensive. The company's vehicles are equipped with external cameras, cabin-facing cameras, ultrasonic sensors, and continuous telematics transmission. Tesla has acknowledged using vehicle footage for machine learning purposes, and its data retention practices have drawn scrutiny in both the United States and European regulatory contexts.
Ford, Hyundai, and Kia have each appeared in legal proceedings related to data collection practices, while Toyota and Honda have been criticized for the opacity of their connected services terms rather than specific documented violations.
The common thread is not malice but rather a structural incentive: vehicle data has substantial commercial value, and the legal and regulatory environment in the United States has not yet imposed meaningful constraints on its collection or use.
What American Drivers Can Realistically Do
The surveillance architecture embedded in modern vehicles is not easily dismantled. However, a series of practical measures can meaningfully reduce your exposure.
Audit your connected services enrollment. Access your vehicle manufacturer's owner portal — OnStar, Toyota Connected Services, Ford Pass, or the equivalent — and review every active subscription and data-sharing agreement. Disable programs you did not knowingly activate.
Opt out of telematics-based insurance programs explicitly. If you have enrolled in usage-based insurance or received communications from your insurer referencing driving behavior data, contact your carrier and request written confirmation of what data has been collected and shared, and request removal from any data-sharing programs where opt-out is available.
Limit third-party application permissions. Review the permissions granted to any application that interfaces with your vehicle's infotainment system. Revoke microphone and location access for applications that do not require them functionally.
Understand your state's privacy protections. California residents benefit from the California Consumer Privacy Act (CCPA), which grants rights to know, delete, and opt out of the sale of personal information — rights that extend to vehicle data. Several other states have enacted comparable legislation. Determine what rights apply in your jurisdiction and exercise them formally through written requests to your automaker.
Consult your vehicle's Event Data Recorder disclosure. Federal law requires that owners be informed if their vehicle contains an EDR. Review your owner's manual for this disclosure and understand that EDR data — which captures the seconds before a collision — may be accessed by insurers, attorneys, and law enforcement following an incident.
Consider the implications before purchasing a new vehicle. Privacy researchers and consumer advocates recommend reviewing a manufacturer's privacy policy before purchase, not after. The disparity in data practices between manufacturers is real, and it is a legitimate factor in an informed buying decision.
The Road Ahead
Federal legislative attention to automotive data privacy has intensified in recent years. The bipartisan Driver Privacy Act has been referenced in congressional discussions, and the Federal Trade Commission has signaled increased scrutiny of automaker data practices. Whether those signals translate into enforceable regulation remains to be seen.
In the interim, the burden falls on individual drivers to understand what their vehicles record, to question the terms they accept, and to take deliberate steps to limit surveillance they have not meaningfully consented to.
